What these terms cover

These terms apply when a developer or estate agency ("you") books paid placements on proplaunch.my with OutSpace Studio (registration no. 202603250620 (AS0522077-D), "we" or "us"): banner slots in the Featured carousel, featured listings, a better project page or the agency partner plan.

Each booking has a quote that sets out what you are booking, where, for how long and the price. The quote and these terms together make up our agreement. If the quote and these terms differ, the quote applies.

Booking

A booking is confirmed when you accept the quote in writing (email is fine) and we confirm the dates back to you. Each carousel has a fixed number of slots, so slots go to confirmed bookings in the order we receive them. A quote is valid for 14 days unless it says otherwise.

Prices and payment

• Prices are in Malaysian ringgit and exclude any tax that applies, which we add to the invoice.
• We invoice when the booking is confirmed. Payment is due within 14 days of the invoice, and before the placement starts unless the quote says otherwise.
• If payment is late, we may hold the placement until it is paid. The booked end date stays the same.

Your content

You supply the images, text, floor plans and project details for your placement. By sending them, you confirm that:

• you own them or have permission to use them, and to let us show them on PropLaunch;
• they are accurate and kept up to date, including prices, unit types and dates;
• they comply with Malaysian law, including the Housing Development (Control and Licensing) Act 1966 and its regulations. For housing developments, this means showing a valid developer's licence and advertising and sales permit where the law requires them.

How we show it

You allow us to show, resize and crop your content for the placement during the booking. We may ask you to change content, or decline it, if it is misleading, unlawful or does not fit the format.

Every paid placement is labelled Featured. Payment buys the placement only: it does not change the project facts we show, such as prices, unit counts or permit details, and we will not present a placement as our recommendation.

Agency partner plan

• Your agency must be registered with the Board of Valuers, Appraisers, Estate Agents and Property Managers (BOVAEP), and every negotiator who contacts buyers must be registered too. We check your registration number before we start and may check it again during the plan.
• Each project has one partner agency at a time.
• Buyer enquiries we pass to you may only be used to answer that enquiry. You must handle them under the Personal Data Protection Act 2010, contact buyers promptly, and not sell or share them.
• Tell us straight away if your registration lapses or is suspended. We will stop the plan from that date.

Reports and results

We send views and clicks for each placement every month. We do not promise a number of views, enquiries, viewings or sales.

If a placement does not run

If, through our fault, your placement is not shown for more than 3 days in total in a month, we extend it by the same number of days or credit you for them, whichever you prefer.

Cancelling and pausing

• You can cancel by email up to 14 days before the start date and we refund what you paid, less any work already done on your content.
• After the start date, you can cancel with 30 days' notice. We refund any whole months that have been paid for but not yet started after the notice period.
• We may pause or end a placement, without a refund for the time already shown, if your content breaks these terms or the law, your licence, permit or registration lapses, or an invoice is unpaid for more than 30 days.

Liability

As far as the law allows, our total liability for a booking is limited to the fees you paid for that booking in the 3 months before the claim, and we are not liable for lost profits, sales or enquiries. You are responsible for claims that arise from the content you supplied.

Changes and law

We may update these terms; bookings already confirmed keep the version in place when they were confirmed. These terms are governed by the laws of Malaysia, and the courts of Malaysia deal with any dispute about them.
